1. Provocation exists when someone directly incites, through print, broadcasting, or any other similarly effective means that facilitates publicity, or in the presence of a group of people, the commission of a crime.

For the purposes of this Code, advocacy is the presentation, before a group of people or through any means of dissemination, of ideas or doctrines that glorify crime or praise its perpetrator. Advocacy will only be considered a crime as a form of provocation and if, by its nature and circumstances, it constitutes a direct incitement to commit a crime.

2. Provocation will be punished exclusively in the cases provided for by law.

If the provocation is followed by the commission of a crime, it will be punished as incitement.
