Article 116 [source]

Spanish Criminal Code
English translation

1. Every person criminally responsible for a crime is also civilly liable if damages or losses arise from the act. If two or more people are responsible for a crime, the judges or courts shall determine the share for which each is liable.

2. Perpetrators and accomplices, each within their respective category, shall be jointly and severally liable for their shares, and subsidiarily liable for the shares corresponding to the other responsible parties.

Subsidiary liability shall be enforced: first, against the assets of the perpetrators, and then, against those of the accomplices.

In both cases where joint and several liability is enforced and subsidiary liability is enforced, the right of recourse of the party who has paid against the others for the shares corresponding to each shall be reserved.

3. The criminal liability of a legal entity shall entail its civil liability under the terms established in Article 110 of this Code, jointly and severally with the natural persons convicted for the same acts.
