1. The same property shall be returned, whenever possible, with compensation for any deterioration or damage determined by the judge or court. Restitution shall take place even if the property is in the possession of a third party who acquired it legally and in good faith, without prejudice to their right of recourse against the appropriate party and, where applicable, their right to be compensated by the party civilly liable for the offense.
2. This provision does not apply when the third party has acquired the property in the manner and with the requirements established by law to render it irrecoverable.
