1. A breach of a security measure involving confinement shall result in the judge or court ordering the individual's return to the same facility from which they escaped or to another facility appropriate to their condition.
2. In the case of other measures, the judge or court may order the substitution of the breached measure with confinement if the latter is provided for in the relevant circumstances and if the breach demonstrates its necessity.
3. In both cases, the judge or court shall issue a report of the breach. For these purposes, the individual's refusal to undergo medical treatment or to continue medical treatment initially agreed to shall not be considered a breach of the measure. However, the judge or court may order the substitution of the initial or subsequently refused treatment with another measure applicable to the relevant circumstances.
