Acts that may be classified under two or more provisions of this Code, and are not included in Articles 73 to 77, shall be punished according to the following rules:
1. The special provision shall be applied in preference to the general one.
2. The subsidiary provision shall be applied only in the absence of the principal provision, whether such subsidiarity is expressly declared or tacitly inferred.
3. The broader or more complex penal provision shall encompass those that punish the offenses covered by it.
4. In the absence of the preceding criteria, the more serious penal provision shall exclude those that punish the act with a lesser penalty.
